Quilt Listing Agreement
BuyAQuilt.com
is dedicated to your success in selling your quilts.
Please read this carefully, as it will govern what we will do
and what you must do.
BuyAQuilt.com Agrees to:
* Display on the
BuyAQuilt.com website, your submitted listing of quilt image,
description, your prices, your shipping methods, and your
contact information as supplied by you.
* Maintain said
listing for the specified fee amount (see fee schedule below)
and for the specified time period of the Listing Agreement.
* Not be held
responsible or liable in any way for transactions between
buyer and seller, or sales or lack of sales.
* Reserve the right
for any reason to refuse to display a quilt, or provide
service to any person.
* Not be responsible
for any sales taxes due or labeling requirements for items
sold.
* Remove your listings
from this site and/or refuse services to you if (a) you breech
this agreement, or (b) we believe that your actions might
cause a financial loss or potential liability for us or for
our users, or yourself.
* Reserve the right to
modify this agreement at any time, and notify you by email if
and/or when any modifications are made.
Quilter as
Seller Agrees to:
* Supply to
BuyAQuilt.com for the listing:
-
the necessary photos (either
digital or regular)
-
a description of the quilt
including size in inches
-
the selling price of the
quilt
-
method you will use to send
the quilt to the buyer
-
stated refund policy and be
prepared to be responsible for replacing any defective quilts,
including new shipping and mailing expenses. There will
be no refunds by BuyAQuilt.com on any refunds or replacements
of quilts
-
stated required method of
payment by your buyer
-
your email contact
information and/or mailing address
* Be responsible for
packing, shipping, handling and insurance expenses, including
assuming the risk of loss or damage resulting from shipment of
the quilt (note that you should either state the separate
shipping and handling charges, or include it within the whole
price of the quilt, to be charged to the buyer)
* Notify BuyAQuilt.com
by email when a sale is pending on a listed quilt. This
enables us to put a "sale pending" sign on your listing and
will help to prevent conflicting sales. In the event of
payment by two buyers, the second occurring payment must be
refunded with an explanation of the circumstances.
* Notify BuyAQuilt.com
by email when a listed quilt is sold. This enables us to
put a "sold" sign on your listing.
* Provide your buyer
with a delivery date as well as the method of delivery.
* Ensure that quilt
patterns used are either copyright free, or provide proof that
permission by the designer has been granted for use. If
a copyright infringement issue should arise, the quilt will
automatically be removed until the issue is satisfactorily
resolved in the Quilter/Seller's favor.
* Guarantee that the
quilt offered for sale is of their own making, and that they
are legally able to sell the quilt they list for sale on
BuyAQuilt.com.
* Be responsible to
charge, collect and remit any sales taxes due on the items
sold.
* Be responsible for
any required textile labeling requirements.

* Agree to indemnify
and hold harmless BuyAQuilt.com for any claim or demand made
by any third party due to, or arising out of, your breach of
this Agreement, or of any law or the rights of a third party.
* Agree that nothing
in this Agreement creates any partnership, joint venture,
agency, franchise, sales representative relationship, or
employment relationship between the parties.
* Agree that any
disputes between yourself as the Seller and any Buyers will be
handled by you with no involvement by BuyAQuilt.com.
Listing Fees
One quilt (any size, any
price)..................................$9.50
Listing length is for three months (90 days) from time of payment.
A listing fee is non-refundable.
The listing fee is to be paid by PayPal payment at the time of
listing your quilt for sale.
For a limited
time (until 12/31/07), there will be no listing length requirement.
Also, unlike
other sites, we will not charge you a commission fee, or take a
percentage of your sales price as a fee. 100% of what you
make is yours to keep. And unlike some other sites, we do
not charge you more if you list a larger quilt even though you
will make more money for a larger quilt. Also unlike some
other sites, we don't charge another fee to "enhance" your
listing with special fonts and colors, etc. Do you really
think this will sell your quilt? Nope. Your buyer
falling in love with your description and the picture of your
quilt will sell your
quilt!
